Qualified Medical Evaluation

Making Sure Your Physician is Certified

In order to seek benefits from your employer after you have suffered a work-related injury, you must receive a medical evaluation from a physician who is certified to examine injured workers by the California Division of Workers' Compensation Medical Unit. These physicians are known as Qualified Medical Evaluators and they have the power to evaluate disability claims and write medical legal-reports. Medical legal-reports provide pertinent information and guidance for the process of settling a workers' compensation claim.

After informing your employer of your injuries, you will be provided with a claim form and information about which Qualified Medical Evaluator (QME) you must go to for your examination. It is the responsibility and job of the QME to fully and fairly assess the extent of your pain and injuries, and to provide supportable opinions about how the case can be finalized. The QME has the ability to evaluate head injuries and brain injuries by testing the effect of injuries on the memory, concentration, attention, reasoning ability and other cognitive skills.

Seeking Compensation After a Workplace Accident

The treatment that the QME deems necessary will be covered under workers' compensation benefits and you have the right to receive medical treatment immediately after you are injured. However, complications can arise when the claims adjuster disagrees with the treatments that the physician prescribed. It is helpful to have the assistance and representation that an Oakland workers' comp attorney can provide during this time so that you can recover the compensation you need to pay for your medical treatments and bills.

The Law Offices of Jonathan M. Brand has been serving injured victims in Oakland and the surrounding areas since 1989, and the attorneys at the firm are passionate about helping every client recover the full amount of workers' comp available.
