Temporary Disability Benefits

What are temporary disability benefits?

Temporary disability benefits are provided for employees who are unable to perform their work duties while they are recovering from a work-related injury or illness. If you have suffered spinal cord or back injury while at work and you are undergoing rehabilitation, you may be able to seek temporary disability benefits until you return to work or until your condition has reached a point of maximum recovery.

In order to obtain these benefits, you must have medical documentation of your disability status. It is wise to seek the counsel of an Oakland workers' comp lawyer if you have been injured and are pursuing benefits for temporary disabilities or permanent impairment. These claims may be complex and you may be unable to recover the full benefits available because of employer interference or a denied claim.

You may be eligible to start receiving temporary disability benefits on the fourth day that you are absent from work because of a work-related injury or illness. The amount that you will be paid is determined by law at a rate of two-thirds your weekly salary, and you should start receiving payments no later than 14 days after your employer has been notified of your temporary disability status.

The law now places a 2-year-cap on these benefits from the date of the first payment, and the few exceptions to this rule include cases where a worker has one of several severe injuries. A workers' comp lawyer at the Law Offices of Jonathan M. Brand can help you fill out the DWC-1 Form to ensure that you qualify for all benefits. You may qualify for temporary partial disability benefits even if you can do some work while you are recovering, but you will receive temporary total disability benefits if you can't work at all.
